A guardian can petition the court if they want to resign and transfer guardianship to another individual. However, the court will ultimately determine and appoint the new guardian. Therefore, the guardian can’t simply transfer guardianship without involving the court.

Transfer guardianship

To transfer guardianship, the guardian must petition the court. He or she must explain to the court why they no longer want to be or are able to be the guardian.

Additionally, if a guardian is not fulfilling their duties, another person can petition the court to have the guardian removed, and a new guardianship put in place.

Most states have forms individuals can complete to start the petition process. The specific forms may vary per state.
