If a hospital, healthcare facility, or medical provider has violated your rights, you can:

  • File a complaint with the hospital, provider, or health insurer to give them a chance to fix the situation
  • File a complaint with the state’s department of health if the issue wasn’t adequately addressed or resolved
  • File a lawsuit them if you’ve been harmed by the violation and their actions

HIPAA violation

If you suspect a HIPAA violation, you can contact the Office for Civil Rights (OCR) to file a complaint. You can file a complaint online using their portal or by mail, fax, or email. Under HIPAA rules, a covered entity can’t retaliate against you for filing a complaint.

When filing a complaint with the OCR, you need to provide details about your complaint and yourself. Additionally, complaints should be filed within 180 days of the event.
